Last Updated: 6/3/2025
Welcome to Artify ("Artify", "we", "us", or "our")! We are committed to protecting your personal information and your right to privacy. If you have any questions or concerns about this privacy notice, or our practices with regards to your personal information, please contact us at [email protected].
This Privacy Policy applies to all information collected through our web application (the "Service"), and/or any related services, sales, marketing or events.
1. What Information Do We Collect?
Personal Information You Disclose to Us
We collect personal information that you voluntarily provide to us when you register an account on the Service, express an interest in obtaining information about us or our products and services, when you participate in activities on the Service, or otherwise when you contact us.
The personal information that we collect depends on the context of your interactions with us and the Service, the choices you make, and the products and features you use. The personal information we collect may include the following:
- Account Information: Email address, username, password (hashed), and other details provided during account creation via our authentication provider (e.g., BetterAuth).
- Payment Information: When you purchase Credits, our third-party payment processors (e.g., Bkash) may collect payment information. We do not directly store sensitive payment details like full credit card numbers.
Information Automatically Collected
We automatically collect certain information when you visit, use, or navigate the Service. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Service, and other technical information. This information is primarily needed to maintain the security and operation of our Service, and for our internal analytics and reporting purposes.
- Image Data: When you use our service to transform images, you upload images ("User Content"). We process these images to apply the selected artistic style. The original images and the generated images are temporarily stored on our servers to provide the service and allow you to access the results.
2. How Do We Use Your Information?
We use personal information collected via our Service for a variety of business purposes described below:
- To facilitate account creation and logon process. We use the information you allowed us to collect for account creation and login (e.g., via BetterAuth).
- To provide, operate, and maintain our Service. This includes processing your uploaded images to generate transformed artwork and managing your purchased Credits.
- To manage user accounts. We may use your information for the purposes of managing your account and keeping it in working order.
- To send administrative information to you. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.
- To protect our Services. We may use your information as part of our efforts to keep our Service safe and secure (for example, for fraud monitoring and prevention).
- To respond to user inquiries and offer support. We may use your information to respond to your inquiries and solve any potential issues you might have with the use of our Services.
- For other business purposes. We may use your information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns, and to evaluate and improve our Service, products, marketing, and your experience.
Uploaded images and prompts are processed to generate the stylized artwork. This may involve sharing the image data with third-party AI model providers solely for the purpose of performing the transformation. We instruct these providers to use the data only for this purpose and to delete it thereafter, according to their terms. We aim to minimize data retention and delete processed images from our active systems after a reasonable period necessary to provide the service (e.g., allowing you to download your artwork).
3. Will Your Information Be Shared With Anyone?
We only share information with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill business obligations.
- Compliance with Laws: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
- Vital Interests and Legal Rights: We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
- Third-Party Service Providers: We may share your data with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf and require access to such information to do that work. Examples include: payment processing (e.g., Bkash), data analysis, email delivery, hosting services, customer service, authentication services (e.g., BetterAuth), and AI model providers for image processing. We only share the minimum information necessary for them to perform their designated functions and do not authorize them to use or disclose your information for their own marketing or other purposes.
- Business Transfers: We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.
4. Cookies and Similar Technologies
We may use cookies and similar tracking technologies (like web beacons and pixels) to access or store information. Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Policy [User: Consider creating a separate Cookie Policy or detailing it here]. For now, we state that we use essential cookies for site functionality, authentication, and security.
5. How Long Do We Keep Your Information?
We keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). Generally, this means we will keep your account information for as long as you have an account with us. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
Uploaded and generated images are typically retained only as long as needed to complete the transformation task and deliver the result to you, plus a short buffer period for access (e.g., 24-72 hours), after which they are scheduled for deletion from our active systems. Backups containing this data may be kept for a longer period as per our standard backup retention policies.
6. How Do We Keep Your Information Safe?
We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Service is at your own risk. You should only access the Service within a secure environment.
7. What Are Your Privacy Rights?
In some regions (like the EEA, UK, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. To make such a request, please use the contact details provided below.
If you are relying on consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
If you have questions or comments about your privacy rights, you may email us at the contact information below.
